A fatal Texas house crash involving a Tesla using Full Self-Driving (FSD) has escalated from a disputed technology failure to a criminal case focused squarely on the human behind the wheel.
Timeline of the crash and investigation
In June 2026, 44-year-old Michael Butler was driving a Tesla on a residential street in Katy, Texas, with Tesla’s Full Self-Driving (Supervised) system engaged when the car left the road and slammed into a house, killing 76-year-old resident Martha Avila. Security camera footage later reviewed by federal investigators showed the vehicle accelerating through an intersection, leaving the roadway and striking the home in clear, dry, daytime conditions.
In the immediate aftermath, Butler reportedly told police he had “passed out” and claimed Tesla’s autopilot features were engaged at the time of the crash. Days later, Elon Musk publicly rejected the idea that FSD could have caused a high‑speed neighborhood collision, arguing that “FSD drives slowly through neighborhood streets and this was a high speed crash!”
Data shifts focus to driver control
Tesla’s internal review indicated the driver had fully depressed the accelerator in the residential area, with the car exceeding 70 mph just before impact. The National Transportation Safety Board’s preliminary report, released in mid-July, confirmed that data: “the driver manually overrode self-driving by pressing the accelerator all the way to 100 percent of the accel pedal,” supporting Tesla’s account that its driver-assistance system “wasn’t to blame.”
The National Highway Traffic Safety Administration also opened a probe, while local police charged Butler with manslaughter. The victim’s family sued both Butler and Tesla, alleging negligence and raising questions about potential vehicle defects despite the NTSB’s findings.
Phone data suggested Butler had been working as a DoorDash driver and had searched terms like “Tesla FSD not aggressive enough 2026” and “Tesla FSD too timid,” hinting at frustration with the system’s caution before the crash.
As the investigation continues, regulators are examining both human behavior and automated systems, but the preliminary data has, for now, tilted legal and public scrutiny toward the driver rather than Tesla’s FSD.
